A woman is set to receive a $ 5.2 million (16 4.16 million) cash prize from a car insurance company after she “contracted a sexually transmitted infection from her ex-boyfriend” while having sex with his Hyundai Genesis. The unprecedented crisis in the United States could redefine the kind of “trauma” that companies will have to pay for in the future. The woman contacted GEICO General Insurance Company in February 2021 to request payment, claiming that she had contracted HPV from one of her insurance members in his vehicle. The human papillomavirus is the name of a common group of viruses – with the NHS saying that most people will get one type of the disease in their lifetime. They do not cause any problems in most people, but some types can cause genital warts or abnormal cell changes that can sometimes turn into cancer. Court documents seen by MailOnline show that the woman claimed that her ex had been told she had HPV and a cancer of the throat. But he continued to have unprotected sex with her, while knowing the dangers, he claimed. He was reportedly found responsible for not sharing the infection status and GEICO was ordered to pay the woman $ 5.2 million in damages and injuries. The insurance company challenged the decision, arguing that it violated the company’s rights in a fair trial and that the arbitration agreement was unenforceable. But a panel of three judges in the Missouri Court of Appeals found that Jackson County District Court was not wrong in dismissing their allegations.

While the outcome of the case is unheard of, the payment was called “reasonable” by Los Angeles personal injury lawyer Miguel Custodio. He said: “If you think of it as an injury that occurred while he was in this person’s vehicle, then it falls entirely within what an insurance company would have to pay. “Usually, the injuries of the passengers are the result of a collision or knocking on the door with his fingers, something like that. “But while an insured driver’s lawsuit may be the first of its kind, this award shows that it is not difficult for someone to file a lawsuit against an insurance company for any action that takes place on a motor vehicle.” Mr Custodio claims that the decision could affect even other insurance claims. For example, experts may need to assess whether one can claim money from home insurance providers if they enter into an STD at their partner’s home. He added that companies would now call in “an army of lawyers” to find a way to prevent similar claims.
