The plaintiff, a woman from Missouri who is only identified as M.O., says she had sex with her partner in a car insured by the Geico company. According to court documents, she allegedly contracted the HPV (human papillomavirus) virus because the man did not tell her he had the infection. HPV can lead to cervical cancer if left untreated and can also lead to genital warts. In February last year, MO told Geico, a Maryland-based company, that it planned to sue them for $ 1 million because the man’s policy with them should have covered her “injuries and losses.” Geico refused to pay for the settlement, claiming that its “injury” did not result from “normal use of the vehicle”. An arbitrator later ruled that she should be awarded $ 5.2 million in damages. The woman then applied to Jackson County Court to claim her compensation money. On Thursday, a panel of three Missouri Court of Appeals judges upheld its claim following several appeals by Geico. But the company says it is planning a federal lawsuit to argue that the woman is not covered by her boyfriend’s insurance policy. In a statement Thursday, Geico said the lawsuit would determine whether “there is coverage in this matter”.
